Description

Medicare Advantage Denials: Appeal, Escalate or Let Go? A Decision Framework for 2026

Most Medicare Advantage denials are never challenged, and most of the ones that are challenged do not survive. The question is not whether appeals work. It is which denials deserve your team's time, and which need something stronger than another appeal.

This 90-minute session gives you a practical decision framework. Every denial gets one of four answers: fix and resubmit, appeal, escalate, or let it go on purpose. You will learn a two-minute triage that sorts any denial correctly, so your team stops spending appeal capacity on errors it should correct and stops appealing the same plan behavior one claim at a time.

The session puts the federal rules to work. You will see how CMS-4201-F requires plans to follow Medicare's coverage criteria and the Two-Midnight Rule, how CMS-0057-F put prior authorization on a clock with specific denial reasons, and how the CY 2026 Medicare Advantage rule protects approved inpatient admissions. You will also learn why your contract status decides your rights: non-contracted providers have the full Part C appeal process with a Waiver of Liability, while contracted providers work through their provider agreement.

You will walk through the five-level appeal ladder and its 2026 deadlines and dollar thresholds, the fast-track appeals when skilled nursing, home health or hospital care is ending, and how to build an appeal packet written for the Independent Review Entity that reads it second. Four worked cases show the framework in action, from an approved inpatient stay paid as observation to a skilled nursing stay cut short.

Finally, the session shows how to turn repeated denials, downcoding and underpayments into evidence: a denial log, five monthly measures, the plan's own published numbers and the contract terms worth negotiating. Raj Sharma, RN, CPC, CPB, explains each rule in plain operational language and ties every step to the regulation you can cite.

Areas Covered in the Session:-

  • The scale of the problem: Medicare Advantage enrollment, prior authorization volume and the appeal gap.
    • 4.1 million prior authorization denials in 2024; 11.5 percent appealed; 80.7 percent of appeals overturned.
    • What the first insurer-posted 2025 data shows, and why two overturn rates are both correct.
  • What HHS-OIG and the Senate found about inappropriate denials and post-acute care.
  • The new front: auto-downcoding and line-item underpayments.
  • The rules that give you leverage.
    • CMS-4201-F: Medicare coverage criteria, published internal criteria and the Two-Midnight Rule.
    • CMS-0057-F: 7-day and 72-hour decisions, specific denial reasons and public metrics.
    • No later medical-necessity denial of an approved service, and the CY 2026 limit on reopening approved admissions.
  • Where the Physician Fee Schedule meets Medicare Advantage payment, and the CY 2027 proposals to watch.
  • Organization determinations, contracted versus non-contracted providers and the Waiver of Liability.
  • The five-level appeal ladder, filing deadlines, the Independent Review Entity and the 2026 thresholds.
  • Expedited reconsiderations and fast-track appeals for SNF, home health and hospital discharge.
  • The decision framework: fix, appeal, escalate or let go, and the two-minute triage.
  • Anatomy of an appeal that wins, the criteria map, physician attestations and peer-to-peer calls.
  • Four worked cases from common Medicare Advantage denials.
  • Escalation that changes plan behavior: denial log, monthly measures, contract terms and reporting to CMS.
  • Team roles, AI appeal tools and a 30-60-90 day action plan.
  • Live Q&A Session.

Background:-

Medicare Advantage now covers 55 percent of eligible Medicare beneficiaries, about 35.2 million people in 2026, so a plan's coverage decisions now decide whether a large share of every practice's and hospital's Medicare revenue gets paid. In 2024, Medicare Advantage plans fully or partially denied 4.1 million prior authorization requests. Only 11.5 percent of those denials were appealed, yet 80.7 percent of the appeals were partly or fully overturned (KFF analysis of CMS data).

At the same time, the rules have changed in providers' favor. Since January 1, 2026, plans must decide standard prior authorization requests within 7 calendar days and urgent requests within 72 hours, give a specific reason for every denial, and publish their own approval, denial and appeal numbers. An approved service can no longer be denied later for lack of medical necessity, and an approved inpatient admission cannot be reopened on information gathered afterward. Most denial teams have not yet built these rules into their appeals.

Why Should You Attend:-

  • Read a Medicare Advantage denial for the rule it relies on, your rights and the deadline that is running.
  • Apply CMS-4201-F coverage criteria and the Two-Midnight Rule in appeals.
  • Use the CMS-0057-F decision timeframes and specific-reason requirement as leverage.
  • Understand how the 2024 and 2026 rules protect approved services and admissions.
  • Distinguish contracted and non-contracted provider rights, and when a Waiver of Liability is required.
  • Choose correctly between a payment appeal and a payment dispute.
  • Navigate the five-level appeal ladder, its deadlines and the 2026 dollar thresholds.
  • Know when to use expedited and fast-track appeals.
  • Sort any denial into fix, appeal, escalate or let go using a two-minute triage.
  • Build an appeal packet that cites the rule and maps the record to the criteria.
  • Find downcoding and underpayments that never appear in a denial report.
  • Turn denial patterns into escalation, contract leverage and measurable results.
